Terms of Service

These Terms of Service (the "Terms") govern your use of Aether (the "Service"), accessible at https://trynoguard.com. By creating an account or otherwise using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 18 years old to use the Service. By using the Service you represent and warrant that you are of legal adult age in your jurisdiction and have the legal capacity to enter into these Terms. Aether is intended for adults only and is not directed at minors.
2. Nature of the Service — uncensored AI
Aether provides access to an uncensored, minimally-moderated large language model and image generation tools. Outputs are generated by AI based on your prompts and may include content that is graphic, sexual, violent, controversial, factually incorrect, offensive, or otherwise objectionable. You acknowledge that:
- The Service is provided "as is" for use by adults who specifically want this kind of tool.
- AI output is not advice and may be wrong, misleading, biased, or fabricated.
- You must independently verify anything you intend to rely on (legal, medical, financial, technical, factual).
- You are solely responsible for the prompts you submit and for what you do with the outputs.
3. Your responsibility for your use
Whatever you ask the Service, whatever you generate, and whatever you do with the output is your responsibility — not ours. Aether does not endorse, encourage, recommend, or vouch for any output. We do not monitor or pre-screen prompts or outputs in real time. If you choose to act on something the AI says, that decision and any consequences belong entirely to you.
You agree not to use the Service to:
- Generate sexual content involving minors (CSAM). This is a hard, absolute prohibition. Violations will be reported to law enforcement and to NCMEC where required by law.
- Plan, attempt, or carry out violence against specific real people, or generate true threats.
- Create malware, ransomware, or material designed to compromise computer systems you do not own and are not authorized to test.
- Generate content for the purpose of harassing, doxxing, or impersonating a real, identifiable person.
- Generate weapons-of-mass-destruction synthesis instructions (CBRN).
- Use the Service in violation of any applicable law in your jurisdiction.
- Resell, scrape, mirror, or redistribute the Service or its outputs as your own AI product.
- Attempt to extract, reverse-engineer, or impersonate the underlying model or system prompts.
Outside of the prohibitions above, the Service is intentionally permissive. We do not police roleplay, fiction, kink, NSFW imagery between consenting adult fictional characters, controversial opinions, dark humor, drug discussion, security research questions, or other adult-coded content. That is the product. If that's not what you want, this is the wrong service.
4. Accounts and security
- You are responsible for keeping your password secure and for everything that happens under your account.
- We log IP address, user-agent, and approximate location for every sign-in for security and abuse-prevention purposes. These logs are retained indefinitely.
- We may suspend or terminate your account if you violate these Terms, attempt to defraud the billing system, or appear to be running a shared/resold account.
- We may force-logout sessions or rotate credentials at any time if we suspect compromise.
5. Credits, plans, top-ups, and refunds
- The Service is metered in "credits." Credits are not currency, are not redeemable for cash, and have no value outside the Service.
- Plan credits refresh daily up to your plan's monthly cap and reset monthly. Top-up credits are paid one-time, stack on top of plan credits, and do not expire while your account is in good standing.
- Subscriptions auto-renew at the listed price until you cancel. You can cancel anytime; cancellation stops future charges but does not refund the current period.
- All sales are final. We do not offer refunds for unused credits, partial months, or change-of-mind. We may issue a refund at our discretion in cases of clear billing error.
- Prices, plan inclusions, and credit costs may change. Material changes that affect paid plans will be communicated before the next billing cycle.
6. Intellectual property
- You retain ownership of your prompts. To the extent we have any rights in the AI-generated outputs you create, we assign them to you, subject to these Terms.
- You are responsible for ensuring your use of any output complies with copyright, trademark, publicity, and other applicable laws in your jurisdiction.
- Aether, the Aether name, the brand and the look-and-feel of the Service are owned by us. You may not use them without permission.
7. Privacy
We store your account data, conversations, generated images, usage events, and sign-in logs (including IP address) on our infrastructure for as long as your account exists, in order to operate the Service, prevent abuse, and respond to legal requests. We do not sell your data. Conversations are not used to train third-party foundation models. Where required by law we will respond to lawful requests from law enforcement.
8. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR PRODUCE ANY PARTICULAR RESULT. WE DO NOT WARRANT THAT AI OUTPUTS ARE TRUE, SAFE, LAWFUL, NON-INFRINGING, OR APPROPRIATE FOR ANY USE.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AETHER, ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
We are not responsible for what you ask the Service, what the Service answers, what you generate, what you look up, what you research, what you click on, what you read, what you copy, what you publish, or what happens to you or anyone else as a result. That is on you. You use the Service at your own risk.
10. Indemnification
You agree to indemnify, defend, and hold harmless Aether and its operators from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) content you submit or generate; (c) your violation of these Terms; or (d) your violation of any applicable law or any third-party right.
11. Suspension and termination
We can suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, are engaged in fraud or abuse, or if continuing to provide the Service to you would expose us to legal or financial risk. You can stop using the Service at any time. On termination, your right to use the Service ends, but sections 3, 6, 7, 8, 9, 10, 12, 13, 14, and 15 survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date and, where appropriate, an in-product notice. Continued use after changes take effect means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the operator of Aether resides, without regard to conflict-of-laws rules. Any dispute will be resolved in the competent courts of that jurisdiction, unless local consumer-protection law gives you a non-waivable right to use a different forum.
14. No class actions; jury waiver
To the extent permitted by law, you and we each waive the right to a jury trial and the right to participate in any class, collective, or representative action against the other.
15. Miscellaneous
- If any provision of these Terms is unenforceable, the remaining provisions stay in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms; we may.
- These Terms are the entire agreement between you and us regarding the Service.
