Terms of Service

1. Acceptance

By creating an account or using Aether (the “Service”), you agree to these Terms of Service. If you don't agree, don't use the Service. We may update these terms; material changes will be announced in-app or via email at least 14 days before taking effect.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement. The Service is provided to you as an individual; commercial resale, white-labeling, or sublicensing is not permitted without prior written agreement.

3. Account and access

Public signups are not currently available. Accounts are provisioned by invitation. You are responsible for keeping your credentials secure. You are responsible for activity under your account.

4. Acceptable use

Your use of the Service is governed by our Acceptable Use Policy, which is incorporated by reference. Categorical prohibitions include sexual content involving anyone who could be a minor, non-consensual sexual content involving identifiable real people, content facilitating violence against specific real people, and coordinated harassment.

5. Pricing and credits

The Service is priced via plan subscriptions and one-time credit top-ups. Plan credits reset monthly and do not roll over. Top-up credits do not expire. We reserve the right to change pricing with 30 days' notice for existing subscribers.

6. Intellectual property

Output generated by the Service in response to your prompts belongs to you, subject to the underlying model providers' license terms (most permit broad commercial use). You retain rights to your prompts. The Service software, branding, and infrastructure remain our property.

7. Privacy

Conversation data is stored to your account so you can access it. We do not train models on your data. See our Privacy Policy for full details.

8. Termination

You may cancel your account at any time. We may suspend or terminate accounts that violate these terms or the AUP. On termination, plan credits stop renewing; top-up credits are forfeited only in cases of substantial AUP violation.

9. Disclaimer

The Service is provided “as is.” AI-generated output may be inaccurate, biased, or contain errors — verify before relying on it for consequential decisions. We make no warranties, express or implied, regarding fitness for purpose.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from your use of the Service is limited to the total amount you paid us in the preceding 12 months.

11. Governing law

These terms are governed by the laws of the jurisdiction of Aether's incorporation. Disputes will be resolved through binding arbitration where permitted.
